prepared for the change. Mayor Gamec asked if the City is able amend the Charter. this way or if <br />it must come from the Charter Commission to the Council. City Attorney Goodrich replied in <br />this particular form of amendment it is to be recommended from the Charter Commission to the <br />City Council with an affirmative vote of all councilmembers. Within 60 days after passage and <br />publication of the ordinance a petition requesting a referendum on the ordinance can be filed <br />with the City Clerk. The problem with this proposal is that there is not a recommendation from <br />the Charter Commission. Secondly, the proposed effective date of January 1, 2011 is different <br />from the effective date of.January 1, 2008 that was advertised. Mr. Goodrich indicated he will <br />.need to research whether_~his motion is legal. He advised his recommendation would be to pass <br />the amendment contingent on approval by the Charter Commission and contingent on the -City <br />- Attorney determining it will be an effective ordinance. <br />Motion on the floor amended as follows: To adopt Ordinance No. 06-12- amending Section <br />2.1 of the City Charter requiring that the City be governed by the Council-Manager Form. of <br />Government with the following change: an effective date of January 1, 20.11, contingent on <br />approval by the Charter Commission and contingent on-the City Attorney determining it will be <br />an effective ordinance. <br />Further discussion: Councilmember Elvig stated the Charter Commission did come forward and <br />initiate this Charter amendment. The Council could not get the recommendation passed in its <br />entirety, only from the standpoint of the date. However, the essence of the Charter Commission <br />recommendation is the change to the City Manager Form of Government from several <br />standpoints outlined in Mr. Frederick's letter. The Council is not wavering from that direction;. it <br />is only the timeframe they cannot agree on. Councilmember Strommen request input from Ms. <br />LeMere. Ms. LeMere explained these are the same discussions the Charter Commission had. It <br />is difficult to come up with a date. A future date will run into the same issue as 2008 with an <br />incumbent in the position and a change in the position; she does not know how this is addressed <br />in the Human Resources rules. The Commission considered future dates and population <br />thresholds. Ideally the change would be effective immediately. Mayor Gamec commented there <br />will be new councilmembers coming on, and there is also. the possibility of a referendum. The <br />incoming councilmembers will now have time to study -this more as Councilmember-Elect <br />Dehen had requested. Ms. LeMere noted that the current Council is in support of changing to a <br />City Manager Form of Government; however, they run the risk if that will be the consensus of <br />the Council when new members are added.
