1 a. The animal control officer will provide the owner of a dog that has been deemed dangerous, per this <br />2 section, with a dangerous dog notice. <br />3 b. If the dog has met any of the criteria for dangerous dogs as defined in this chapter, a quarantine <br />4 notice will also be provided to the owner advising of a ten-day quarantine period. <br />5 c. If a proper enclosure cannot be provided for the dog, the animal control officer can seize the dog for <br />6 the quarantine period. All costs of the care, keeping, and disposition of the dog are the responsibility <br />7 of the owner or person claiming an interest in the dog. <br />8 d. Any person knowing of a human being bitten by a dog shall immediately notify the animal control <br />9 officer and said dog shall then be confined and kept under observation for a period of ten days before <br />10 being removed from the owner's property or destroyed. Alternately, the dog shall be euthanized and <br />11 immediately tested for rabies at the owner's expense. <br />12 e. An owner of a dangerous dog shall follow all requirements for dangerous dogs as stated in Minn. Stat. <br />13 § 347. <br />14 (3) Dangerous dog registration. <br />15 a. Requirement. No person may own a dangerous dog in this state unless the dog is registered as <br />16 provided in this section. <br />17 b. Registration. An animal control authority shall issue a certificate of registration to the owner of a <br />18 dangerous dog if the owner presents sufficient evidence that: <br />19 i. A proper enclosure exists for the dangerous dog and a posting on the premises with a clearly <br />20 visible warning sign that there is a dangerous dog on the property, including a warning <br />21 symbol to inform children; <br />22 ii. A surety bond issued by a surety company authorized to conduct business in this state in a <br />23 form acceptable to the animal control authority in the sum of at least the minimum allowed <br />24 by Minnesota Statute, payable to any person injured by the dangerous dog, or a policy of <br />25 public liability insurance issued by an insurance company authorized to conduct business in <br />26 this state in the amount of at least the minimum allowed by Minnesota Statute, insuring the <br />27 owner for any personal injuries inflicted by the dangerous dog; <br />28 iii. The owner has paid an annual fee as established by an annual fee schedule and regulated <br />29 per Minn. Stat. § 347 to obtain a certificate of registration for a dangerous dog under this <br />30 section; and <br />31 iv. The owner has had microchip identification implanted in the dangerous dog with the name <br />32 of the microchip manufacturer and identification number of the microchip provided to the <br />33 animal control authority. If the microchip is not implanted by the owner, it may be <br />34 implanted by the animal control authority. In either case, all costs related to purchase and <br />35 implantation of the microchip must be borne by the dog's owner. <br />36 c. Warning symbol. If an animal control authority issues a certificate of registration to the owner of a <br />37 dangerous dog pursuant to this chapter, the animal control authority must provide, for posting on the <br />38 owner's property, a copy of a warning symbol to inform children that there is a dangerous dog on the <br />39 property. The warning symbol must be the uniform symbol provided by the commissioner of public <br />40 safety. The commissioner shall provide the number of copies of the warning symbol requested by the <br />41 animal control authority and shall charge the animal control authority the actual cost of the warning <br />42 symbols received. The animal control authority may charge the registrant a reasonable fee to cover <br />43 its administrative costs and the cost of the warning symbol. <br />44 d. Fee. The animal control authority may charge the owner an annual fee as established by an annual <br />45 fee schedule to obtain a certificate of registration for a dangerous dog under this section. <br />Page 10 of 15 <br />
