CC Regular Session <br />Meeting Date: <br />02/10/2026 <br />7. 1. <br />Primary Strategic Plan Initiative: Connect the community through Parks, Trails and Recreational Programming <br />Title: <br />Adopt Resolution #26-042 Authorizing Contract Amendment with H & U Construction for Improvement Project <br />#25-58, Waterfront Waterplay Park Improvements <br />Purpose/Background: <br />The purpose of this case is to approve an amendment to the contract with H + U Construction (previously limited <br />to the preconstruction management services) for the Waterfront Waterplay Park Improvements project —with an <br />amendment to the A 133-2019 contract for actual construction of the park project as a Construction Manager at <br />Risk (CMAR) with a Guaranteed Maximum Price (GMP) for the water play plaza and associated improvements <br />at The Waterfront. <br />Considerable background and detail on this project is included in the attached October 28, 2025, City Council <br />case and attachments. Due to file size constraints, attachment #6, the Waterfront Draft Drawings, are not <br />included. <br />Time Frame/Observations/Alternatives: <br />As indicated, in October 2025, City Council approved a contract with H & U Construction for preconstruction <br />and bidding services —with that work concluding (on time and under budget) with bids received and organized <br />under a proposed amendment to the contract for a GMP of $3,624,184 for the construction of the park project at <br />The Waterfront. <br />The Bid Tabulation and all other scope and costs included in the GMP are detailed within the first attachment to <br />this case (this document is also referenced within the Resolution as Exhibit A). Included in the GMP submittal <br />are the recommended owner allowances to be approved for the project that are necessary to complete the <br />construction of the park within the coming months. These are itemized under letter B on page 8 of this first <br />attachment. It can be clarified here that the totals represented by the GMP and the owner allowances may be <br />thought of as a not -to -exceed amount for the project —portions of contingencies or allowances may not be needed <br />in whole or in part, and therefore any monies unspent, would remain in the Park Trust Fund. <br />Resolution #26-042 authorizes entering into a contract amendment with H & U as a CMAR with a <br />Guaranteed Maximum Price of $3,624,184 for the water play plaza and associated improvements at <br />The Waterfront —together with an owner's allowance of $128,500, all of which shall be funded from the <br />Park Trust Fund for a total project allocation of $3,752,684. <br />Additional information will be presented during the meeting. <br />Funding Source: <br />All construction costs and disbursements that this case discusses, would be funded by the Park Trust Fund. <br />
