<br />CASE # 8 <br /> <br />REQUEST FOR QUIT CLAIM OF REMNANT PARCEL OF CITY PROPERTY <br />By: Steven Jankowski, City Engineer <br />" <br /> <br />Background: <br /> <br />On December 21, 2006 the city received the letter from Mr. James Provinzino the owner <br />ofthe property at 6304 Highway 10 requesting that the City quit claim to him a 2022 <br />square foot parcel which is located between his property and Riverdale Drive. A copy of <br />" . <br />Mr. Provinzino's letter and a map illustrating the general area of the subject parcel are <br />attached. <br /> <br />When Riverdale Drive was constructed in 1989 the'land acquired by the City created a <br />number of small remnant parcels of land on the north side of the 80 foot wide right of <br />way. Sanitary sewer and water utilities are located in Riverdale Drive. Mr. Provinzino's <br />letter refers to parcel 2A which is 1815 square feet which was quit claimed to Blue Line <br />collision so that Blue line would have legal access to the municipal utilities as well as <br />ingress and egress to Riverdale Drive. Mr. Provinzino is requesting that Parcel1A which <br />is 2022 square feet be similarly quit claim to him for the same reasons. Attached to this <br />case is the information on this parcel provided by the Anoka County <br /> <br />Parcel Bl was quit claimed to Mr. Rick Haugland (Blue Line Collision) on June 6,2001 <br />with the city retaining drainage and utility easements over the parcel. The costs of <br />preparing the quit claim deed and associated fees were to be paid by the grantee. <br /> <br />Recommendation: <br /> <br />Staff recommends that this parcel be quit claim<;:d to the adjacent property owner <br />contingent upon the grantee preparing a quit claim deed which retains drainage and utility <br />and trail easements in favor of the City over the subject parcel, and that the grantee be <br />responsible for all legal review and recording costs. Once the quit claim deed is prepared <br />an ordinance will need to be passed for the property to be disposed by the City. <br /> <br />Action: <br /> <br />Motion to recommend to City Council that this parcel be quit claimed to the adjacent <br />property owner contingent upon the grantee preparing a quit claim deed which retains <br />drainage and utility and trail easements in favor of the City over the subject parcel, and <br />that the grantee be responsible for all legal review and recording costs. <br /> <br />Reviewed by: <br />Public Works Director/Principal Engineer <br />Fire Chief <br />City Attorney <br /> <br />PW: 01/16/07 <br /> <br />11 <br />
