. 2nd violation written notice shall be given by registered mail with the warning of a 'penalty. It was noted if the violation results in a misdemeanor it would carry its own penalty. City Engineer Jankowski indicated the definition of a violation should be better defined than it is currently stated in the draft ordinance. Public Works Director Olson indicated staff will research violation penalties in relation to misdemeanors with the Police Chief and City Attorney. Consensus of the Committee was to direct staff to include a revised draft ordinance for violations of the sign ordinance on the agenda of the January Public Works Committee meeting based on the above discussion. Case #3: 2007 Street Maintenance Program City Engineer Jankowski. indicated a draft Feasibility Study for the 2007 Street Maintenance Program will be presented at the December City Council meeting. The Feasibility Study was not available for this meeting due to the need for corrections. Mr.) ankowski advised the 2007 Street Maintenance Program consists of thirteen individual projects addressing the maintenance needs o~ 23.1 miles of City streets. Projects 07-01 through 07-07 which covers 16.5 miles of City streets, 'will receive a sealcoating preceded by sealing of cracks having widths which exceed one- quarter inch. Projects 07-08 through 07-13 which involve 6.6 miles of street, will receive a one and one-half inch bituminous overlay of the existing bituminous pavement. The 2007 program includes the sealcoating of 4.2 miles ofMSA street. City Engineer Jankowski stated the City has conducted an annual Street Maintenance Program since 1981. It has, been the City's policy to assess 50% of the cost associated with these improvements. A complete listing of the City's policies concerning the assessment practices are summarized in Appendix C of the feasibility study. The initial step of this process has.been the presentation pf the program to the Public Works Committee. Mr. Jankowski reviewed the following funding sources proposed for the 2007 Street Maintenance Program: · General Fund: $372,519 · Assessments: $372,519 · MSA Funds: $121,166 · Developer Escrows: $ 27,673 · Total: $893,876 City Engineer Jankowski explained the General Fund contribution for the 2007 program is $400,000. However, some of the streets scheduled for 2006 may need to be completed in 2007; a change order in the amount of $27,000 was entered into at the time the job was awarded in 2006 for the situation of work that may need to be completed in 2007. This $27,000 would come off the $400,000 budgeted for the 2007 program. Mr. Jankowski indicated staff is open to any direction the Committee may have on. the draft Feasibility Study.
