<br />CASE # lC] <br /> <br />RECIEVE PETITION FROM PONDV ALE RESIDENTS <br />By: Leonard Linton, Civil Engineer II <br /> <br />Background: <br /> <br />The City received a petition from Pondvale Residents for a feasibility study for a water and <br />sewer project on a portion of 150th Lane and Helium Street on January 16, 2007. The City has <br />received several petitions in the past for extension of sewer and water in this area, the last <br />petition was brought to the January 24, 2006 City Council Meeting. Council directed staff at <br />that time to contact each of the residents with the message that the residents would be <br />responsible for the cost of the feasibility study update if the project is not constructed. The 2006 <br />petition was determined to be invalid and was rejected. Staff requested an estimate for updating <br />the feasibility study and received a reply that Hakanson Anderson who performed the original <br />estimate can update the study for a maximum not to exceed amount of $1500. Staff has also <br />received a letter from Dan Murphy indicating he will pay for the updated feasibility study if the <br />project is not constructed. This was one of the conditions applied by the City Council when the <br />2006 petition was received. <br /> <br />Funding Source: <br /> <br />The petitioner has provided a letter indicating he will cover the cost of updating the feasibility <br />study. It may be prudent to require this amount be escrowed prior to ordering the update of the <br />feasibility study. <br /> <br />Staff Recommendation: <br /> <br />Staff recommends acceptance of the petition for a water and sewer project in Pondvale on a <br />portion of 150th Lane and Helium Street and ordering the update of the feasibility study. <br /> <br />Council Action: <br /> <br />Motion to accept the petition for a water and sewer project in Pondvale on a portion of 150th <br />Lane and Helium Street. <br /> <br />Motion to approve updating of the Feasibility Report for Street, Storm Sewer, Water and <br />Sanitary Sewer for Pondvale Estates, City Improvement Project #02-22, by Hakanson Anderson <br />on an hourly cost basis with a maximum not to exceed amount of$1500. <br /> <br />Reviewed by: <br />Public Works Director/Principal City Engineer <br /> <br />CC: 1/23/07 <br /> <br />-355- <br />
