Commissioner Van Scoy expressed concern in locating the tower this close to an R-1 property.
He indicated he is also a little concerned about trying to approve a site plan without the actual
setbacks determined yet.

Chairperson Nixt noted the worst case scenario would be a 10 foot setback. This would be 10
feet to the edge of the compound, which will be 30 feet from the center of the tower, so the
minimum distance from the edge of the property to the center of the tower is 30 feet.

Commissioner Cleveland expressed concern with the setback being so close to an R -1 area. She
questioned what the maximum distance is that the base of the tower will take up.

Mr. Edwards indicated the base of the tower will be a 6 foot diameter and will taper up to about 1
Y2 feet at the top.

Commissioner Levine indicated he is comfortable with the safety aspects of the tower location.

Motion by Commissioner Levine, seconded by Chairperson Nixt, to recommend that City
Council adopt Findings of Fact favorable to a request from T-Mobile to construct a
telecommunications tower on the fire station property.

Motion carried. Voting Yes: Chairperson Nixt, Commissioners Levine, Cleveland, Hunt, and
Trites Rolle. Voting No: Commissioner Van Scoy. Absent: Commissioner Brauer.

Motion by Commissioner Levine, seconded by Chairperson Nixt, to recommend that the City
Council approve the request for a conditional use permit, based on Findings of Fact and adopt a
resolution declaring terms of same, contingent upon the applicant submitting an acceptable
landscaping plan, the shifting of the tower compound to the north and west, within the
permissible setbacks; and contingent upon a rezoning of the property to Public-Quasi Public.

Chairperson Nixt made a friendly amendment to recommend that the City Council consider what
other personal utilization they might fmd appropriate for the tower and to work with the applicant
to make arrangements to accommodate that use.

Motion carried. The property is currently zoned R-1 Residential
and is guided low density residential by the Comprehensive Plan. In order for the development
to proceed, a rezoning to medium density housing will be required, as well as a comprehensive
plan amendment to Medium Density Residential.

Planning Commission/January 4, 2007

P8
