Police Chief Bluml explained that this was the second review of a proposed ordinance to amend <br />the City code related to municipal tobacco licenses, noting that updates are necessary due to <br />significant changes to State law in 2020. He stated that the revisions include updates to definitions, <br />administrative penalties, compliance check requirements, and the minimum legal sale age. He <br />explained that the ordinance would repeal and replace the existing code to align with current laws <br />and ensure consistent enforcement, and noted that the City Attorney assisted with and approved <br />the revisions. Police Chief Bluml concluded by stating that staff recommends adoption of the <br />ordinance and that he was available for questions. <br />Motion by Councilmember Buscher, seconded by Councilmember Peters, to adopt Ordinance #26- <br />04, Amending Chapter 26, Article XVI Tobacco, sections 26-749 to 26-789 of the City Code. <br />A roll call vote was performed: <br />Councilmember Buscher aye <br />Councilmember Stewart aye <br />Councilmember Specht aye <br />Councilmember Peters aye <br />Mayor Pro Tem Riley aye <br />Motion carried. <br />7.02: Adopt Resolution #26-082, Amending Development Agreement with Northstar Truck <br />& RV Parking <br />City Administrator Hagen summarized the Development Agreement previously approved by <br />Council on January 27, 2026 and the proposed amendment to the agreement. <br />Mayor Pro Tem Riley asked whether the businesses were now in compliance and expressed <br />concern that they were not, questioning whether the development agreement should be amended. <br />City Administrator Hagen stated the site is not yet fully compliant but has made some progress. <br />He explained the amendment only affects the financial guarantee and noted all improvements are <br />still due by June 1, 2026. <br />Councilmember Buscher asked whether approving the amendment would impact the City or <br />compliance. <br />Mayor Pro Tem Riley noted no action is required unless the Council chooses to amend the <br />agreement. <br />City Attorney Johnson explained the agreement has not been signed and the Council can either <br />approve a reduced letter of credit or require the original higher amount, with no impact on code <br />enforcement. <br />City Council / March 24, 2026 <br />Page 4 of 6 <br />
