• the developer is paying park dedication, and he would be wiling to make sure there is an <br />easement to make the trail connection some day. <br />Mayor Gamec noted the trail actually lines up with a park in Elk River. <br />Consensus of the Council was to require the developer to provide an easement for a future trail, <br />rather than constructing a sidewalk as required in the Staff Review Letter. <br />Motion by Councilmember Cook, seconded by Councilmember Olson, to adopt Final Plat <br />Resolution 406 -12 -406 approving the Final Plat for Northfork Office Condos, with the exception <br />of the requirement for construction of sidewalk along 156` Avenue, and authorizing staff the <br />flexibility to require the developer to provide a trail easement, contingent upon compliance with <br />the City Staff Review Letter, specifically addressing the following items: <br />1. Subunit a revised grading and utility plan that is satisfactory to the Engineering <br />Department <br />2. Produce a copy of a utility operating agreement between EcoCheck and the developer <br />3. A viable community septic system and well being constructed to meet the demands for all <br />15 buildings <br />4. Developer entering into a development agreement with the City of Ramsey <br />Further discussion: Mr. Walz stated they cannot grant the City an easement because they are <br />using 100% of their property due to the significant portion on the right side that runs along <br />• Burlington Northern Railroad property. Mayor Gamec replied providing staff this authorization <br />gives the City the leeway if it is needed. <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Olson, Elvig, Jeffrey, <br />Pearson, and Strommen. Voting No: None. <br />Case #10: Adopt Ordinance to Rezone Property from E -1 Employment to Planned Unit <br />Development (PUD); Case of Saint Andrew's Investment Group, LLC <br />Community Development Director Trudgeon explained Saint Andrews Investment Group, LLC <br />is seeking a rezoning to Planned Unit Development (PUD) to accommodate 15 lots on 8 acres for <br />the Northfork Offices Condos site plan and final plat that was just approved. A PUD is needed <br />because City Code does not provide standards for lots being developed as common- interest- <br />communities.
