WHEREAS, pursuant to Article 5, Section 3, of the Minnesota State Constitution, <br />Governor Tim Walz is required to "take care that the laws be faithfully executed." This has been <br />recognized as the Governor's most significant responsibility as the Minnesota Supreme Court <br />stated: "the position of the President under the federal Constitution in respect to his duty to execute <br />the laws of Congress is precisely that of the Governor under our state Constitution in respect to <br />the laws enacted by our Legislature"; and <br />WHEREAS, the Governor's repeated, intentional failures to faithfully execute all state <br />laws constitute nonfeasance, a breach of his duties and official misconduct and has caused a <br />dramatic loss in available funding to the City for urgent, necessary, and legitimate public needs <br />and purposes; and <br />WHEREAS, not only have the City and City residents been damaged and harmed by the <br />Governor's repeated, intentional failures, but all communities in the State have been harmed by <br />the Governor's nonfeasance; hardworking taxpayer money was stolen and continued to be stolen <br />because even after the Governor was made aware it was happening, he did nothing to stop it. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) The City Administrator and City Attorney are directed to further investigate the claims that <br />the City may have against Governor Tim Walz, Attorney General Keith Ellison, and/or the <br />State of Minnesota related to the damage caused to the City due to their breach of duties, <br />official misconduct, and nonfeasance related to the mismanagement of taxpayer money. <br />2) The City Administrator and City Attorney are directed to investigate the legal means to file <br />claims against Governor Tim Walz, Attorney General Keith Ellison, and/or the State of <br />Minnesota separately or in conjunction with other municipalities of the State of Minnesota. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember , <br />and upon vote being taken thereon, the following voted in favor thereof: <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this <br />12rh day of May, 2026. <br />Resolution #26-111 <br />Page 2 of 2 <br />
