Community Development Dh'ector Frolil<. noted that the surrounding properties were notified, but <br />no public comment has been received. <br /> <br />Mr. R. ichmond stated that when he applied 'for the permit he went around to all the neighbors <br />informing them el" what he was doing. He explained that the case before the City Council states <br />conditional use permit, but all he was asking for was a variance. At the time he purchased the <br />property he was under tine understanding that the City had a two-acre minimum on lot sizes and <br />on a two-acre lot, an accessory structure can be up to 2,064 square feet. He is proposing to have <br />2,064 in accessory buildings. In working with staff on the issue they pulled a plat map that <br />included a note indicating that his lot -,,vas 1.94 acres, which is the reason all this was taking <br />place, l-lc stated thai he thought he was doing everything correctly v,;hen he ~roceeded with the <br />proj cot. <br /> <br />Mayor Gamec inquired as to the reason i-'or requiring the conditional use permit over a variance. <br /> <br />Community Development Director Frolil< explained that a variance is For dimensional issues only <br />when they can't meet setbacks and have to prove a hardship. As staff amends Chapter 9 o1:' City <br />Code they are going to include a provision in the variance language for practical difficulty. <br /> <br />Motion by Councilmember Cool<, seconded by Councilnaember Kural<, to adopt Resolution #03- <br />05-109 adopting lrindings of Fact ~0647 relating to Daryl and Carol Ridamond's request Fora <br />conditional use pemnit to exceed accessory structure size restrictions on the property at 17623 <br />Mam~oset Street NW. <br /> <br />Further discussion: Councilmember Zimmerman inquired ii-' the lot size is calculated by not <br />including the right of way. Colnmunity Development Director Frolil< replied yes. <br />Councilmember Elvig complimented Mr. Richmond lot discussing tim prqicct with his neighbors <br />prior to proceeding ~brward. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Cool<, Kurak, Elvig, Pearson, <br />Strommcn. and Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Cool<, seconded by Councilmember Kural<, to approve IDaryI and <br />Carol Richmond's request to exceed accessory structure size restrictions based on Findings of <br />Fact fi0647 and adopt R. eso[ution #03-05-110 declaring terms of same. <br /> <br />Motion carried.
