stating the nature of the violation and requiring repair or removal of the sign within,.,,,jo:~+" ~,,,,;ram thirty (303 <br />days of the date of the order. <br /> <br />9.12.22 Removal of Signs by the Zoning Administrator <br /> <br /> Subdivision 1. The Zoning Administrator may cause the removal of any illegal sign, any <br />sign remaining after a business permanently closes, or any sign not properly maintained in cases of <br />emergency, or after failure to timely comply with written orders for removal or repair. After removal or <br />demolition of the sign, a notice shall be mailed to the sign owner and owner of the property where the <br />sign was located stating the nature of the work and the date on which it was performed and demanding <br />payment of the costs as certified by the Zoning Administrator together with an additional fifty percent <br />(50%) for inspection and incidental costs. <br /> <br /> Subd. 2. If the amount specified in the notice is not paid within thirty (30) days after <br />mailing of the notice, it shall become a lien against the parcel where the sign was located and shall be <br />certified as an assessment against the property together with ten percent (10%) interest for collection in <br />the same manner as the real estate taxes. <br /> <br /> Subd. 3. The owner of the parcel upon which the sign is located shall be presumed to be <br />the owner of all signs thereon unless facts to the contrary are brought to the attention of the Zoning <br />Administrator. <br /> <br /> Subd. 4. In case of emergency, the Zoning Administrator or Building Official may cause <br />the immediate removal of a dangerous or defective sign without notice. Signs removed in this manner <br />must present a hazard to the public safety as defined in the State Building Code. <br /> <br />9.12.23 Appeals. To provide for a reasonable interpretation of the provisions of this Ordinance, a <br />permit applicant who wishes to appeal an interpretation by the Zoning Administrator may file a written <br />appeal with the City Administrator and request a hearing before the City Council. The City Council <br />shall hear the appeal, make findings and take its action. <br /> <br />9.12.24 Variance Variations. Requests for va6mac-~ variations from the provisions of this <br />Section shall be processed by the applicant applying to the Zoning Administrator for a conditional use <br />permit, which conditional use permit procedure shall be as prescribed in {}9.03.04 of the City Code. <br /> <br />9.12.25 Conflict. If any portion of this Section is found to be in conflict with any other provision <br />of any zoning, building, fire, safety or health ordinance of the City Code, the provision which establishes <br />the higher standard shall prevail. <br /> <br />9.12~26 Severability. If any subsection, sentence, clause, or phrase of this Section, or its <br />application to any person or circumstance is held invalid by the decision of any court of competent <br />jurisdiction, the remainder of this Section, or the application of the provision to other persons or <br />circumstances is in effect and shall remain in full force and effect. <br /> <br />Historical Note <br /> <br />281 <br /> <br /> <br />
