108 <br /> <br />If any court of competent jurisdiction shall adjudge invalid the <br />application of any provision of this Chapter to a particular property, <br />building or other structure, such judgment shall not affect the <br />application of said provision to any other property, building or <br />structure not specifically included in said judgment. <br /> <br />9.01.06 Rules of Construction and Interpretation <br /> <br /> Subdivision I. Conflicting Conditions. Where the conditions <br />imposed by any provision of this Chapter are either more or less restrictive than <br />comparable conditions by another provision of this Chapter or by other Chapters of the <br />City Code, rule or regulation of the City, the provision which imposes the more <br />restrictive condition, standard, or requirement shall prevail .... <br /> <br /> Subd. 2. Language Rules of Construction. The language set forth in <br />the text of this Chapter shall be interpreted in accordance with the following rules of <br />construction: <br /> <br />a. The singular number includes the plural, and the plural the singular. <br /> <br />The present tense includes the past and future tenses, and the future <br />the present. <br /> <br />c. The word "shall" is mandatory while the word "may" [s permissive. <br /> <br />d. The masculine gender includes the feminine and neuter. <br /> <br />Whenever a word or term defined hereinafter appears in the text of <br />this Chapter, its meaning shall be construed as set forth in the <br />Definitions Section of this Chapter. <br /> <br />All measured distances expressed in feet shall be the nearest tenth of <br />a foot. <br /> <br />9.01.07 Enforcement of Penalties <br /> <br /> Subdivision 1. Any violation of this Chapter may be enjoined by the <br />Council through proper legal channels. Each day a violation is permitted to exist shall <br />constitute a separate offense. <br /> <br /> Subd. 2. In case any building, structure, or land is proposed to be erected, <br />reconstructed, altered, converted, maintained or used in violation of this Chapter, the <br />Council, in addition to other remedies, may institute in the name of the City any <br />appropriate action or proceeding to prevent, restrain, correct or abate such building, <br /> <br />9.01 - Introduction <br /> <br />9-2 Jan.
