2) <br /> <br />3) <br /> <br />Update on NPDES Phase II Implementation <br />The Public Works Committee recommended that the City Council direct staff to prepare a <br />Storm Water Pollution Prevention Program for formal adoption. <br /> <br />Request for Extension of Sewer and Water <br />The Public Works Committee recommended that the City Council authorize staff to hire <br />Bolten and Menk at a cost not to exceed $8,500, plus the cost of the lead contamination <br />consultant, for completing a feasibility study for extending urban services to the property <br />identified, contingent upon an escrow being set up to cover all expenses including staff <br />time, the City not being held liable, amendment to the sewer and water comprehensive <br />plan, and the City not having any liability to cover the feasibility study by drafting a <br />contract with the City Attorney, and contacting the MPCA regarding lead contamination <br />standards. <br /> <br />Principal City Engineer Olson stated that he did WOrk with the City Attorney on drafting a <br />resolution that would address most of the issues discussed by the Public Works <br />Committee. The Council action would be for the City Council to adopt a resolution <br />authorizing the preparation of a feasibility study. <br /> <br />Councilmember Cook inquired if all the costs were covered in the resolution to assure <br />that the developer is paying them. <br /> <br />Principal City Engineer Olson explained that the City would be requiring $14,050 be <br />deposited with the City, and it is stated within the resolution that authorization of the <br />feasibility study does not authorize the City to proceed with the project. <br /> <br />Councilmember Zimmerman stated that he thinks that the study encompasses a lot more <br />than feasibility because they would be extending sewer and water 2.3 miles into an area <br />that is not included in the Comprehensive Plan for urban development. He felt that the <br />study was premature. <br /> <br />Councilmember Strommen inquired if the proposal from Golder Associates regarding the <br />lead contamination at the gun club would identify hot spots. <br /> <br />Principal City Engineer Olson explained that what might come out of the study would be <br />an inclusion in the feasibility study that hot spots have to be identified before any <br />construction can occur. <br /> <br />Councilmember Strommen stated that the issue of lead has a large impact on feasibility. <br />The concern she has is if they would be getting enough information from the Phase I <br />study. <br /> <br />City Council/February 11, 2003 <br /> Page 9 of 14 <br /> <br />P15 <br /> <br /> <br />
