southeastern portion of Rabbit Street to the existing Nutria Street located in Autumn meadows, <br />the residential development located immediately to the east of the subject project area. The <br />connection of Rabbit Street to Nutria Street through Autumn Meadows subdivision will require <br />acquisition of approximately 6,150 square feet (0.14acres) from Lot 1, Block I Autumn <br />Meadows. Staff feels connecting Rabbit Street to Nutria Street will provide for an immediate <br />second access to the proposed Tiger Meadows development and provide for a needed second <br />access to the 27-single family lots located east of the subject property that are now currently <br />dependent upon 167th Lane as their sole access. It should be noted that staff did explore the idea <br />of connecting Rabbit Street to Nutria Street through the City Park, which is located just south of <br />the subject property. The City Attorney has stated that public street construction is not permitted <br />through parks. <br /> <br />28 <br /> <br />Staff has contacted the property owner of Lot I, Block 1 Autumn Meadows regarding staff's <br />recommendation to acquire a portion of his property for public right-of-way purposes. The <br />property owner of Lot 1, Block 1 Autumn Meadows has responded to staff's acquisition <br />recommendation through an email attached to this case. The property owner, Mark Anderson, has <br />suggested that the southeastern portion of Rabbit Street in Tiger Meadows be a cul-de-sac. <br />Starting from the cul-de-sac the City should construct a pedestrian pathway, wide enough to <br />accommodate emergency vehicles, through the parkland connecting to Nutria Street (see attached <br />map). It is Mr. Anderson's opinion that constructing an emergency access by means of a <br />pedestrian pathway will achieve the City's desired second access for emergency purposes to <br />Tiger Meadows and the existing 27 single family homes. Mr. Anderson also states that his <br />proposal will eliminate unwanted traffic immediately, adjacent to his property and will provide <br />the existing residential area a nice bike and walking path to the existing park. <br /> <br />Staff has responded to Mr. Anderson's email with the following recommendation: The City <br />would obtain the necessary right-of-way to accommodate a public street from the east plat <br />boundary of Tiger Meadows, through Lot 1, Block 1 of Autumn Meadows and connecting to <br />Nutria Street. The City would construct a 10 foot wide trail within that 60 foot right-of-way. This <br />paved trail would serve as an emergency access until Mr. Anderson sells the property. At that <br />time, the City would convert the trail to a full service public road. In the interim, the trail would <br />be signed as a future through street. <br /> <br />At the request of City staff and the developer, the City Council will be' reviewing staff's <br />recommendation for the acquisition of 0.14 acres of Lot 1, Block 1, Autumn Meadows for public <br />right-of-way purposes, at the April 1, 2003 Council work session. Staff is also trying to <br />coordinate a meeting with the property owner of Lot 1, Block 1, Autumn Meadows to try to <br />achieve a solution or option that meets the approval of the City and property owner. Staff will <br />provide a verbal update to the Planning Commission regarding the outcome of the meeting with <br />the affected property owner and direction staff and the developer receive at the City Council <br />work session. <br /> <br />Recommendation: <br /> <br />It should, be mentioned that the outcome of'the City Council work session on April 1st may <br />require the sketch plan to be modified and therefore the Planning Commission may be asked to <br />review a revised sketch plan at the April 3rd meeting. <br /> <br />Staff is recommending approval of the proposed sketch plan based on compliance with City Staff <br />Review Letter dated March 28, 2003 and the outcome of the Council work session. <br /> <br />I <br />I <br />I <br />I <br />I <br />! <br /> <br />I <br />! <br />I <br />I <br />! <br />I <br /> <br /> <br />
