The order identified the violation as main- <br />taining shrubbery exceeding the maximum permissible height. Singleton re- <br />fused to trim her shrubbery. <br /> Singleton was convicted by the Dayton Municipal Court .for failing to obey <br />a legal order to remedy a housing code violation. <br /> .Singleton appealed. <br />DECISION: Reversed. <br /> Singleton's conviction was overturned: <br /> The underlying legal order directed SLngleton to comply with height re- <br />strictions under the city zoning code. However, the state charged her with rio-' <br />fating the housing code. Failure to follow a housing code order was a cr/minal <br />offense. · <br /> A refusal to trim shrubbery was not a violation of the housing code, but a <br />violation of the zoning code.
