I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br /> <br />Councitmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-02- <br /> <br />RESOLUTION DENYING THE ISSUANCE OF AN INTERIM USE PERMIT TO <br />ALLOW FOR OUTSIDE STORAGE OF COMMERCIAL VEHICLES.. AND <br />EQUIPMENT, PERFORM MECHANICAL WORK, AND PERIODICALLY STORE <br />CLEAN EXCESS CONSTRUCTION/PAVING MATERIALS ON A RESIDENTIALLY <br />ZONED PARCEL, BASED ON FINDINGS OF FACT ii, , AND DECLARING <br />TERMS OF THE SAME. <br /> <br /> WHEREAS, Gerald Bauer, hereinafter referred to as "Permittee", has properly applied to <br />the City of Ramsey (the "City") for an interim use permit to allow outside storage of commercial <br />vehicles and equipment, perform mechanical work and stOre clean excess construction/paving <br />materials on the property generally known as 16130 Variolite Street.and legally described as <br />follows: <br /> <br />The Southwest Quarter of the Northeast Quarter and the Northwest Quarter of the <br />Southeast Quarter in Section 16, Township 32, Range 25; Anoka County, <br />Minnesota. <br /> <br />(the "Site"); and <br /> <br /> WHEREAS, The Planning Commission met on February 6, 2003, conducted a public <br />hearing and recommended City Council deny the request <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />This permit is issued pursuant to Section 9.03104A of the Ramsey City Code. The conditiOns of <br />this permit are as follows: <br /> <br />1) Based on Findings of Fact # ., the request for an interim use permit to <br /> allow Able Paving & Construction to store commercial vehicles and eqUipment outdoors, <br /> perform mechanical work and store clean, excess construction/paving materials .on the Subject <br /> Property is hereby denied to Gerry Bauer ("Permittee"). <br /> <br />2) The Permitte shall be responsible for all City costs incurred in processing this Permit. Said <br /> expenses shall be paid within 15 days of billing by the City and failure to pay the. City's <br /> expenses within the 15 day billing period wiI!' permit the City to draw upon any of the <br /> escrows required by this agreement for payment. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> , and upon vote being taken thereon, the following voted in favor <br />thereof: <br /> <br />27 <br /> <br /> <br />
