Community Devel°pment Director Frolik replied that at the last Planning Commission meeting <br />staff was directed to review the ordinance. <br /> <br />P60 <br /> <br />Case #5: <br /> <br />Request for an Extension of a Conditional Use Permit to Construct and <br />Operate a Cellular Antenna on a City Water Tower; Case of Verizon <br />Wireless <br /> <br />Community Development Director Frolik stated that on October 9, 2002, the City issued a <br />conditional use permit to Verizon Wireless to construct and operate a cellular antenna on the City <br />water tower located off of Sunwood Drive in the AEC Energy Park. City Code states that the <br />applicant has one year to initiate the conditional use permit unless they request and receive an <br />extension. The Planning Commission and City Council must review the extension. Verizon <br />Wireless has not initiated their conditional use permit to construct and operate cellular antennas <br />on the City's water tower. On July 26, 2002, the City received a written request from Jim <br />Nelson, Authorized Agent for Verizon Wireless, requesting an extension to initiate the <br />conditional use permit. The stated reason for the delay in initiating the construction of the <br />equipment, is due to lengthy negotiations between the City Attorney and Verizon Wireless <br />regarding language in the lease agreement. City Staff and Verizon Wireless have now arrived at <br />language acceptable to both parties. A final draft of the lease agreement has been provided to the <br />City Attorney for review and approval. Due to Verizon Wireless's construction schedule, <br />construction of the cellular antenna will most likely not be able to commence prior to August 3 I, <br />2002, when the conditional use permit expires. The Planning Commission reviewed the <br />conditional use permit extension request on August 29, 2002, and recommended that the City <br />Council approve the request. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to adopt ResolUtion <br />#02-09-233 approving a one-year extension to Verizon wireless for the establishment of the <br />conditional use approved for the construction, and operation of a cellular antenna On the City's <br />water tower. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Kurak, Anderson, <br />and Hendriksen.
