Public Hearing <br /> <br />Mayor Gamec called the public hearing to order at 8:58 p.m. <br /> <br />Presentation <br /> <br />I <br />I <br /> <br />Pt36 <br /> <br />City-Council/October 22, 2002 <br /> Page 16 of 35 <br /> <br /> I <br /> <br />'1 <br /> I <br /> .I <br /> <br /> I <br /> i <br /> I <br /> I <br /> I <br /> <br />Community Development Director Frolik stated that Anthony Moulder, W~ho resides at' <br />Roval Road (Lot 4, Block 3, Northfork Oaks Third Addition) has applied foi:.an Administrafi~e'~ <br />Subdivision to acquire a portion of Lot 3, Block 3, Northfork Oaks '.Third Addition from <br />adjoining neighbor to the south. When the cement work for the:applicant's dr/veway and garage <br />pad were completed, the pad was in violation of the side yard setback for accessory structures. <br />The Administrative Subdivision will enable the applicant to comply with the accessory structure-,.::~ <br />side-yard setback as determined in City Code (Section 9.20.1.<1). In conjunction with <br />Administrative S~bdivisigns, a routine procedure is ,to '¢aCate the standard drainage and utility <br />easements on an existing common property line and dedicate, replacement drainage and utility <br />easements on what will be the new common property line. Administrative Subdivisions are <br />approved at a City Staff level and are used for the conveyance of.property between adjacent <br />landowners. Generally, the instrument used to record the land conveyance approved by City <br />Staff is a quit claim deed. However, in-the case of Torrens property, the :only instrument that can <br />be used to record the conveyance is a Registered Land Survey. Registered :Land Surveys require <br />City Council approval. Therefore, it is necessary for the City Council to review and approve this <br />Administrative Subdivision. Both Lots 3 and 4 will'c°ntinue to maintain compliance with the <br />minimum lot size for Northfork after the con~ceYance of.'-,th'e~Property. As part of the <br />Administrative Subdivision, staff was alsO taking the necessary steps to vacate the standard <br />drainage and utility easements on the current'common property line between the two neighbors. <br />The City En gineerhas verified that there are no drainage structures within the existing easements <br />to be vacated. The applicant:will be required to provide the City with replacement easements on <br />the new common property Line with his neighbor. C~ty staff recommended that Council approve <br />the Re~stered Land Survey-for the Administrative Subdivision and introduce an ordinance to <br />vacate the affected drainage and .utility easements. <br /> 2 - " ".'.. ? ~;.::~" <br />Citizen Input - <br /> <br />Tl'fere was none. <br /> <br />Motion to by ~Councilmember Hendriksen, seconded by Councilmember Kurak, to close the <br />public headng~'i , _. <br /> <br />Motion carried.
