Councilmember adoption: introduced the following resolution and moved for its RESOLUTION #02'08- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO WILLIAM AND ELIZABETH ERHART TO EXCEED THE HEIGHT RESTRICTIONS FOR A DETACHED ACCESSORY BUILDING ON PROPERTY LOCATED WITHIN THE METROPOLITAN URBAN SERVICE AREA (MUSA) AND DECLARING TERMS OF SAME: WHEREAS, William and Elizabeth Erhart (Perm/trees) have Properly applied for a conditional use permit to exceed detached accessory building height restrictions for properties located within the Metropolitan Urban Service Area-(MUSA) established in section 9.11.02 "Accessory Uses" of City Code on the property generally known as 4740 154th Lane and legally described as follows:. Lot 11, Block 1, Stanhope Pdver H. ills, Anoka County, Minnesota (Subject Property) WHEREAS, the Planning Commission met on August 2, 2002, conducted the public hearing and recommended City Council approval of the request. NOW THt;REFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOICk COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact # , a Conditional Use Permit (Permit) to exceed detached accessory building height restrictions for properties located within the MUSA as established in City Code, is hereby granted to William and Elizabeth Erhart, hereinafter referred to as the "Permittees". That the detached accessory building may exceed the sixteen (16)' foot detached accessOry building height restriction for properties located within the Metropolitan Urban Service Area by a total of 6 feet in order to match the design of the prinCipal dwelling on the Subject Property. That the detached accessory building constructed on the property will comply with the permitted accessory structure square footage restrictions established in City Code. ' That the construction of the detached, accessory building on the Subject Property shall require issuance of a building permit from the City of Ramsey. '45
