Councilmember introduced the following resolution and moved for its adoption: · RESOLUTION 02-05- A RESOLUTION APPROVING A ONE YEAR EXTENSION TO INITIATE THE CONDITIONAL USE PERMIT ISSUED TO SAINT pAUL TERMINALS, INC. FOR A RECYCLING FACILITY. WHEREAS, the Ramsey City Council (the "City") adopted Resolution #01-06-240 adopting Findings of Fact #0562 relating to a request from St. Paul Terminals for a conditional-use permit to establish a recycling facility; and WHEREAS, on June 26, 2001, the Ramsey City Council approved the request for a conditional' use permit for a recycling facility and adopted Resolution #01-06-24.1 declaring terms of same; and WHEREAS, the Section 9.03.04 of the Ramsey City Code states that a conditional use permit shall expire if the permit holder fails to initiate such conditional use permit and fulfill each and every condition attached thereto within one (1) year from the date of its authorization,, or if the use is discontinued for a continuous twelve (12) month per/od, mnless a petition for an extension of time in which to complete or utilize the use that has been granted by the Council; and WHEREAS, the City of Ramsey received a letter from the Permit Holder's representative, Bradley Martinson of Bradley J. Martinson Law Offices, dated March 20, 2002, in which it is stated that due to economic conditions the Permit Holder has not been able to initiate the conditional use permit and therein requests an extension of time. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That a one year extension to June 26, 2003, is herein granted to the Permit Holder to initiate the conditional use permit for a recycling facility on the' property legally described as follows: Lot I and Lot 2 (except the south 30 feet of Lot 2), Block 4, GateWay InduStrial Park Plat 2, County of Anoka, State of Minnesota Upon written notice being provided by the City to the Permit Holder but without further action by the Planning Commission or Council, this Permit extension shall expire if the Permit Holder fails to initiate such extended conditional use permit and fulfill each and every condition attached thereto by June 26, 2003, unless a petition for an extension of time in which to complete or utilize the use that has been granted by the City Council Such extension shall be requested in writing and filed with the RESOLUTION #02-05- Page i of 2 219
