The following month, another letter informed <br /> him legal action would be taken if he failed to comply. <br /> In June, DeSoto County asked the court for an injunction against Madison <br /> to require compliance with zordng and building regulations. The county claimed <br /> Madison allowed junk: motor vehicles, equipment, and scrap to,accumulate on <br /> his property, willfully violating the zoning ordinances. <br /> Madison responded to the complaint and fried a counterclaim alleging fraud <br /> and malicious prosecution. Among his arguments, he claimed an affidavit filed <br /> by the director of the planning commission was false. <br /> The county denied liability for Madison's claims. After a couple trial dates <br />were set, the county asked the court to find in its favor. Madison asked for <br />more time to 'respond, stating he was under doctor's care and unable to re: <br />spond. The chancellor denied the extension and granted.judgment to the county. <br />Madison appealed.' <br />DECISION: Affirmed. <br /> 1Madison failed to provide appropriate information to establish his medical <br />problems and need for an extension. In addition, there was no evidence pre- <br />sented indicating judgment for the county was inappropriate. <br /> While Madison argued the law hbrary was not open at night md he could <br />not write or take notes at that time due to his health problems, he failed to <br />present information establishing his problem or his need for an extension. <br /> Madison also had claimed the chancellor appeared "to cover and run inter- <br />ference for attorneys" who were challenged by unrepresented individuals. He <br />indicated the licensed attorneys received extensions without good cause while <br />he did not. However, there was nothing in the record indicating the chancellor' <br />applied a different set of rules to Madison. <br />Citation: Madison v.
