Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION #02-05- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST TO EXCEED OUTDOOR STORAGE RESTRICTIONS ESTABLISHED IN <br />THE BUSINESS WAREHOUSE DISTRICT. <br /> <br /> WHEREAS, Tom Sauter, hereinafter referred to as ',Applicant", has properly applied to <br />the City of Ramsey (the "City") for a conditional use permit to exceed outdoor storage <br />restrictions established in City Code on the property located at 6651 141st Avenue and legally <br />described as follows: <br /> <br />Lot 1, Block 1, Gateway North Industrial Park #5, Anoka County, Minnesota. <br /> <br /> ("Subject Property") " <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Plarmi.'ng Commission'for a public hearing' pursuant <br /> to 'Section 9.03.04 of the Rarnsey City Code on May 2, 2002, and that the public hearing was <br /> properly advertised and that the minutes of said public hearing are hereby incorporated' by <br /> reference. <br /> <br />That the Subject Property is zoned BW - Business Warehouse Distr/ct; the adjacent parcels <br />to the north and west are zoned BW - Business Warehouse; property to the east is zoned I - <br />Industrial. <br /> <br />That the permitted uses in the BW - Business Warehouse include office and warehousing <br />activities. <br /> <br />That the permitted accessory uses in the BW - Business Warehouse District restricts outside <br />storage areas to 10% of the Subject Property, which, equates to 1.12 acres (48,961 square <br />feet) on the subject 11.24 acre (489,614 square feet) site. <br /> <br />That the Applicant is requesting to exceed the 10% allowable outdoor storage area by 21%, <br />for a total outside storage area equaling 31% of the Subject Property, or 3.5 acres (153,475 <br />square feet). <br /> <br />6. That the outdoor storage area will be contained within the existing bituminous or aggegate <br /> surfaced areas on the Subject Property. <br /> <br />That the proposed use Mil/will not adversely impact traffic in the area. <br /> <br />That the proposed use will/will not be dangerous or detrimental to persons residing or <br />working in the vicinity of the use or to the public welfare. <br /> <br />10. <br /> <br />That the proposed 'use will/will not substantially or adversely impak the use, enjoyment or <br />market value of surrounding properties. <br /> <br />That the proposed use will/will not be operated and maintained so as to be harmonious and <br />appropriate in appearance with the existing or intended character of the general ViCinity and <br />such use will/will not change the essential character of tke area. <br /> <br />11. That the proposed use will/will not create additional requirements at public cost for public <br /> facilities and services. <br /> <br />57 <br /> <br /> <br />
