AMENDED <br />342 (e) In the event a firm is determined to be non -responsible, the City shall notify the firm and <br />343 proceed to conduct a responsibility review of the next lowest, responsive bidder or, if <br />344 necessary, rebid the project. A Responsibility Determination may be revoked at any time <br />345 if the City obtains relevant information warranting any such revocations. <br />346 <br />347 (f) The City may engage or designate an internal or external construction or project manager <br />348 to ensure compliance with necessary the reviews under this Chapter. <br />349 <br />350 § 2-1101.7. Execution of Final Contract <br />351 (a) A contract subject to this ordinance shall not be executed until all requirements of this <br />352 ordinance have been fulfilled and until a Contractor Responsibility Determination has <br />353 been issued by the City pursuant to Section 2-1101.6. <br />354 <br />355 (b) Prior to the execution of a final contract under this section, the City shall publicly post the <br />356 Notice of Intent to Award, Contractor and Subcontractor Responsibility Certifications, <br />357 Subcontractor Lists, related supporting documentation and the Contractor Responsibility <br />358 Determination on a publicly available website for public inspection for a period of ten <br />359 (10) calendar days after the issuance of the Contractor Responsibility Determination. <br />360 <br />361 § 2-1101.8. False, Incomplete or Misleading Responsibility Certifications <br />362 If the City determines that a Contractor Certification, Subcontractor List or Subcontractor <br />363 Responsibility Certification contains false or misleading information that was provided knowingly <br />364 or with reckless disregard for the truth or omits material information knowingly or with reckless <br />365 disregard of the truth, the firm for which the certification was submitted shall be disqualified from <br />366 the project and shall be prohibited from performing work for the City for a period of three years. <br />367 The City may withhold payment of any monies due to the firm as damages and impose other <br />368 applicable penalties and sanctions, including contract termination, as permitted by law or contract. <br />369 <br />370 § 2-1101.9.
