February " 20071 Volume 11 No.3

Nonconforming Use - Manufacturing business
seeks to relocate its parking lot

Opponent argues new lot amounts to illegal expansion of use

Thomas v. Planning and Zoning Cam'n of Town of Thompson, 98 Conn. App. 742,
911 A.2d 1129 (2006).

CONNECTICUT (12/19/06) - LF. Engineering Corporation owned land
in a residential zone in the town' of Thompson. It operated as a valid non-
conforming use, manufacturing microwave components and subsystems at
a facility on the property. In April 2004, it applied to the town's zoning
commission for permission to relocate its parking lot, which entailed con-
structing a new 20-space parking lot behind its' facility.
A public hearing was held, and Thomas, a neighboring property owneI; op-
posed the application. He claimed that the proposed construction required a spe-
cial permit, and LF.'s application did not meet all of the permit criteria. Thomas
argued that creating the lot amounted to an illegal expansion of a nonconform-
ing use. Despite these objections, the commission approved the application.
Thomas appealed. The court found in favor of the commission, stating that
a regulation related to off-street parking ...:.... and not the restrictions on non-
conforming uses - controlled the case. Regardless, the court stated that the
lot did not constitute an expansion but rather an "intensification" of a permit-
ted use.
Thomas appealed again.

'Mpt91': ,
Drive') I:a

'~t~~ti_lf~~~~~;~.:",:,; ,', ',,~':"

tbnirig,B:ulletin"ispubli5hedand~opyrighted-byThomsohtwest; 610oppem,anDriiie;P,O;, Box 64521i ,,'
,; ,.'
