CASE #1 <br /> <br />REVIEW BUSINESS PARK 95 COVENANTS AS THEY RELATE TO <br />ARCHITECTURAL REVIEW BOARD MEMBERSHIP <br /> By: Sylvia Frolik, Zoning Administrator <br /> <br />Background: <br /> <br />At the August 27, 1998 meeting of the Architectural Review Board, it was the consensus of the <br />members present that the Board make-up should be reviewed for consideration of involving more <br />of the Business Park 95 property owners. <br /> <br />Observations: <br /> <br />Section 3 of the Business Park 95 covenants states that the Board shall consist of two City <br />Planning Commissioners, two Economic Development Commissioners, the City Administrator, <br />and two property owners in the Park. The covenants do not put a time limit on the City's <br />representation on the Board. The two property owners from the Park are supposed to be elected <br />at an annual meeting of the Park property owners and serve on the Board for one year. To date, <br />the required annual meeting to elect Park representatives to the Board has not been implemented. <br />City Staff has recently compiled a listing of businesses and property owners in the Park in <br />anticipation of implementing these annual meetings in the very near future. <br /> <br />Under the current covenants, there presently exists a vacancy on the Board as a result of Dean <br />Sundquist's sale of Command Corporation. <br /> <br />A copy of the covenants is enclosed for your information. <br /> <br />Board Action: <br /> <br />Based on discussion. <br /> <br />ARB: 09/10/98 <br /> <br /> <br />
