9. That Section 9.50.06 (Procedural Variances) establishes a process to grant a variance to • platting requirements, when strict compliance with these requirements may cause a practical difficulty or undue hardship, provided the variance does not affect the spirit and intent of the Section. 10. That the Applicant is requesting a Variance because the platting process causes a,practical, difficulty in that the metes and bounds subdivision will facilitate the conveyance of the 167` Avenue right -of -way to the City and the sale of the existing homes, but will not create any new buildable lots, and therefore, this is not a permanent variance as to said lots. 11. That the need for the Variance will be eliminated by the eventual platting of the remnant parcels and the construction of the 167' Avenue extension. The motion for the adoption of the foregoing resolution was duly seconded by Council Member and upon vote being taken thereon, the following voted in favor thereof. and the following voted against the same: and the following abstained: • and the following were absent: whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this the 27th day of February, 2007.
