# <br />PUBLIC HEARING CASE ;M0 <br />• REQUEST FOR VACATION OF EASEMENTS IN GEBERT'S ADDITION; <br />CASE OF OAKWOOD LAND DEVELOPMENT <br />By: Amy Geisler, AICP, Associate Planner <br />Background: <br />As part of tonight's agenda, the City Council is reviewing a variance to platting request and a <br />moratorium exception request, related to the Brookfield Plat. There are drainage and utility <br />easements on the common property line of the two easterly lots in Gebert's Addition that need to <br />be vacated. <br />The following items are enclosed for your information: <br />a) Site location map <br />b) Exhibit of underlying easements to be vacated <br />c) Proposed ordinance <br />Notification: <br />In accordance with State Statute, City Staff attempted to notify property owners.within 350 feet <br />of the subject property of the public hearing to vacate easements. <br />• Funding Source: <br />All staff costs associated with the review of land use applications are paid for - by the applicant. <br />Observations: <br />As discussed in the variance case, Oakwood Land Development is requesting a metes and bounds <br />subdivision in order to deed land to the City for the extension of 167 Avenue NW. If the <br />variance and subdivision are approved, the drainage and utility easements on the_ common <br />property line need to be vacated. Staff is requesting that new drainage and utility easements be <br />recorded on the new lots for the existing homes. <br />Recommendation: <br />City Staff recommends introduction of the ordinance to vacate the drainage and utility easements <br />as shown in the exhibit of Gebert's Addition. <br />Council Action: <br />Motion to introduce Ordinance #07- to vacate certain drainage and utility easements in <br />Gebert's Addition. — <br />Review Checklist: <br />• Asst.
