platted and sewer and water is brought in. These 5 remnant parcels will not be buildable until <br />they are re- platted. <br />All 3 existing homes are on septic systems. One concern with allowing the metes and bounds • <br />subdivision is to ensure there is sufficient space for an alternate septic site for these homes. The <br />applicant is constructing new septic systems for the 2 easterly lots and has drafted easements to <br />allow an alternate septic on one of the remnant parcels, if needed in the future. The westerly lot's <br />septic system is partially within the right -of -way to be given to the City; this issue will need to be <br />worked out with the applicant. <br />In this situation, the platting requirement is a hardship in that no new buildable lots are being <br />created. The metes and bounds subdivision is necessary to facilitate the transfer of land of right - <br />of -way to the City and to allow the sale of the existing homes. <br />The Public Works Committee discussed the alignment of 167 Avenue on October 17, 2006; <br />meeting minutes are included with the case. The Committee recommended the applicant move <br />forward with the proposed alignment and subdivision process. <br />Because these parcels are located in the Rural Developing Area, which is currently under a <br />development moratorium, a request for exception to the moratorium is also before the Council. <br />Staff Recommendation: <br />City Staff recommends approval of the variance. <br />Council Action: <br />Motion to adopt Resolution 4.07 -02= adopting Findings of Fact #_ relating to <br />Oakwood Development's request for a variance to the platting requirements in Section 9.50 of <br />City Code. <br />Motion to approve Oakwood Development's request for a variance to subdivide by metes and <br />bounds, contingent upon compliance with the City Engineer's Memo dated February 22, 2007 <br />and receipt of an easement vacation, and adopt Resolution #07 -02- declaring terms of the <br />variance. <br />-or- <br />Motion to deny the request for a variance from Oakwood Development based on findings of fact. <br />• <br />Reviewed By: <br />Assistant Community Development Director <br />City Attorney • <br />City Engineer <br />CC: 2/27/07 <br />—84- <br />
