Councilmember Hendriksen inquired as to who the Engineer was on the project. <br /> <br />City Engineer Jankowski replied RLK. <br /> <br />Councihnember Anderson inquired as to why the safety fence was not included. <br /> <br />City Engineer Jankowski replied that he was not sure. <br /> <br />Councilmember Zimmerman inquired if they project could be completed without the fence. <br /> <br />City Engineer Jankowski replied that the fence is needed. <br /> <br />Councilmember Hendriksen inquired as to what the professional liability is with RLK. <br /> <br />City Engineer Jankowski replied that he would have to defer that question to the City Attorney. <br /> <br />Councihnember Hendriksen requested that staff find that information out. <br /> <br />City Engineer Jankowski noted that he was not looking for any action at this point, but wanted to <br />make the Council aware. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Anderson, to recommend <br />that the City Council direct staff to have discussion with the City Attorney as to the responsibility <br />RLK may have to cover some portion of the overages. <br /> <br />Further discussion: Director of Public Works/Fire Chief Kapler suggested requesting a letter of <br />explanation from RLK addressed to the Public Works Committee. Councilmember Hendriksen <br />stated that he would like to know what standard is held to their Engineers from the City Attorney. <br /> <br />Motion carried. Voting Yes: Councilmembers Hendriksen, Anderson, Kurak, Hendriksen, and <br />Zimmennan. VotingNo: None. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Hendriksen, requesting a <br />letter of explanation from RLK to the Public Works Committee explaining the overage, fence, <br />and quantity of block. <br /> <br />Motion carried.
