There are also floodplain areas present on the Subject Property. The majority of the floodplain on the Subject <br />Property is Floodway, but there are smaller portions classified as Flood Fringe (still part of the 100-year <br />floodplain, but allows fill to be used to elevate structures above the flood elevation) and a 0.2% annual chance <br />flood hazard designation (more commonly referred to as a 500-year floodplain), which has no associated <br />restrictions/regulations. Where Erkium Street crosses through the floodplain, there will be some impact. <br />However, the Applicant is proposing to create an additional 65,700 cubic feet of floodplain area to offset the fill <br />needed for the street construction. Overall, there would be no net impact on floodplains. <br />Scenic River Protection Overlay District <br />The existing parcel addressed as 17400 Erkium Street is within the Scenic River Overlay District. This overlay <br />district has several more restrictive bulk standards than the Rural Residential District, including lot size and lot <br />width for riparian lots. Riparian lots shall be at least four (4) acres in size (only applicable to the lot with the <br />existing home on it) and have a lot width of 300 feet at both the building line and the OHW (this is applicable to <br />the lot with the existing home on it as well as those that back up to Trott Brook). It appears that all lots are <br />compliant with these additional standards. <br />Tree Inventory and Preservation Plan <br />A Tree Inventory and Preservation Plan was included with the submittal. Tree cover generally includes a mix of <br />oak species, basswood, American elm, black cherry, quaking aspen, and red pine. The Tree Inventory does not <br />include any trees within the designated floodplain areas, as there is no proposed disturbance to these areas, except <br />for where Erkium Street crosses the floodplain (trees were inventoried in this area). Of the trees inventoried, <br />approximately 35% of the significant tree DBH inches will be removed (City Code would allow up to 60% <br />removal). However, if trees in the floodplain areas were also inventoried, the percentage of DBH inches removed <br />would decrease even more. As proposed, the proposed development complies with the tree preservation <br />requirements and no reforestation/restitution will be required. <br />Landscape Plan <br />A Landscape Plan was not included in the submittal. However, it appears that most lots will preserve trees <br />between the new homes and the street, which would satisfy the requirement of two (2) front yard trees per lot. <br />However, Staff has commented that a Landscape Plan showing two (2) trees per lot should be provided, with a <br />note stating that existing trees, if preserved, between the house and street, then no additional plantings are <br />required. <br />Staff did forward this plan set to the MN DNR, due to a portion of the Subject Property being within the Scenic <br />River Protection Overlay District.
