NOW THEREFORE, BE IT RESOLVED BY THE CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Development Agreement. <br />(a) The Council hereby approves the Development Agreement in substantially <br />the form submitted with the following modifications: (1) Remove Exhibit C and references <br />to Exhibit C or related items; and (2) Add Responsible Contractor Requirement language <br />compliant with Minnesota Statute 16C.285, Subd. 3, subject to City Bond Counsel’s minor <br />modification, review, and approval. The Mayor and the City Administrator are hereby <br />authorized and directed to execute the Development Agreement on behalf of the Council. <br />(b) The approval hereby given to the Development Agreement includes <br />approval of such additional details therein as may be necessary and appropriate and such <br />modifications thereof, deletions therefrom and additions thereto as may be necessary and <br />appropriate and approved by the City officials authorized by this resolution to execute the <br />Development Agreement. The execution of the Development Agreement by the <br />appropriate officer or officers of the City shall be conclusive evidence of the approval of <br />the Development Agreement in accordance with the terms hereof. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Olson, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Heineman <br /> Councilmember Specht <br /> Councilmember Olson <br /> Councilmember Riley <br /> Councilmember Stewart <br /> <br />and the following voted against the same: <br /> <br /> Councilmember Buscher <br /> <br />and the following abstained: <br /> <br /> None <br /> <br />and the following were absent: <br /> <br /> Councilmember Peters <br /> <br /> <br /> <br /> <br /> <br /> <br />Resolution #26-197 <br />Page 2 of 3 <br />
