5. 7. <br />CC Regular Session <br />Meeting Date: <br />09/22/2026 <br />Primary Strategic Plan Initiative: Address infrastructure needs. <br />Title: <br />Adopt Resolution #26-212 authorizing final payment to North Valley, Inc. for Maintenance project #26-53, 2026 Skim <br />Patching. <br />Purpose/Background: <br />Resolution and Pay Request attached. <br />Notification: <br />Final costs overran by 5% due to a small increase in the scope of work to allow additional pavement to be skim patched to <br />ensure the pavement will remain serviceable until future repairs can be completed. <br />Time Frame/Observations/Alternatives: <br />Issuing final payment will be contingent on receipt of the following items from North Valley, Inc. <br />1. IC 134 (Contractor's Withholding Affidavit showing compliance with the provisions of Minnesota Statue 290.92 <br />requiring withholding state income tax). <br />2. Waiver of Mechanic's Lien Rights (Affidavits that all claims against North Valley, Inc. by reason of the contract have <br />been fully paid or satisfactorily secured). <br />3.
