<br />,I <br /> <br />Councilmember Cook introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-06-198 <br /> <br />RESOLUTION GRANTING FINAL PLAT APPROVAL TO PRAIRIE MEADOWS <br /> <br />WHEREAS, National Growth, LLC, hereinafter referred to as "Developer", has properly <br />applied for final plat approval on the following described property located in the City of Ramsey: <br /> <br />The Southeast Quarter of the Northeast Quarter and the Southwest Quarter of the <br />Northeast Quarter, all in Section 07, Township 32, range 25, Anoka County, <br />Minnesota, Except that part platted in the ANOKACOUNTY HIGHWAY <br />RIGHT -OF WAY PLAT NO. 33, according to the recorded plat thereof. <br /> <br />(the "Subject Property") <br /> <br />WHEREAS, on June 2, 2005, the Planning Commission reviewed the sketch plan for <br />Rum River Prairie. <br /> <br />WHEREAS, on February 5, 2006, the City of Ramsey received an application for a <br />preliminary plat for subdivision from National Growth, LLC; and <br /> <br />WHEREAS, on March 3, 2006, the Planning Commission reviewed the application <br />materials, and recommended approval of the preliminary plat with the following contingencies: <br />MPCA approval of the common septic system, resolution of the lot size issues for the existing <br />homes [specific to Kelly Acres], completion of the traffic study, and City Council re- <br />consideration of the cluster ordinance; and <br /> <br />WHEREAS, on April 11 th, 2006, the City Council reviewed the preliminary plat <br />application, and recommended approval of the application with the following contingencies: 1) <br />compliance with City Staff review letter dated February 28, 2006, revised April 5, 2006, 2) <br />obtaining approval from MPCA for the design and location of the community septic system, 3) <br />the City approving the Articles of Incorporation and Declaration of Covenants for the Home <br />Owner's Association at Final Plat, 4) the Developer engaging the services of a professional <br />management firm to manage the community septic system, with a requirement that the <br />management firm be approved by the City, 5) the Developer entering into a Development <br />Agreement as part of the Final Plat approval that will address the payment of Sewer and Water <br />Trunk and Access charges and the responsible party for the maintenance and abandonment of the <br />community septic system; and <br /> <br />WHEREAS, on March 10, 2006, the Parks Commission met, and recommended that <br />Rum River Prairie satisfy <br /> <br />WHEREAS, on June 19th, 2006 the City received Final Plat materials for Prairie <br />Meadows, (formerly Rum River Prairie). <br />
