Councilmember Pearson introduced the following resolution and moved for its adoption: RESOLUTION #06-06-199 RESOLUTION GRANTING FINAL PLAT APPROVAL TO KELLY ACRES WHEREAS, John Osborne and Kelly Wolf, hereinafter referred to as "Developer", have properly applied for final plat approval on the following described property located in the City of Ramsey: Lots 2 and 3, Block 1, LETENDRE ADDITION, according to the recorded plat thereof, Anoka County, Minnesota (the "Subject Property") WHEREAS, on April 21, 2005, the Planning Commission reviewed the sketch plan for Kelly Acres. WHEREAS, on February 5, 2006, the City of Ramsey received an application for a preliminary plat for subdivision from the Developer; and WHEREAS, on March 3, 2006, the Planning Commission reviewed the application materials, and recommended approval of the preliminary plat with the following contingencies: MPCA approval of the common septic system, resolution of the lot size issues for the existing homes (specific to Kelly Acres), completion of the traffic study, and City Council re- consideration of the cluster ordinance. WHEREAS, the City Council met on April 11, 2006 and approved the preliminary plat application contingent upon the following items: 1) compliance with City Staff review letter dated February 28,2006, revised April 5, 2006, 2) obtaining approval from MPCA for the design and location of the community septic system, 3) the City approving the Articles of Incorporation and Declaration of Covenants for the Home Owner's Association at Final Plat, 4) the Developer engaging the services of a professional management firm to manage the community septic system, with a requirement that the management firm be approved by the City, 5) the Developer entering into a Development Agreement as part of the Final Plat approval that will address the payment of Sewer and Water Trunk and Access charges and the responsible party for the maintenance and abandonment of the community septic system; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City of Ramsey hereby grants Final Plat approval for the development of Kelly Acres, contingent upon the following items: I. Compliance with City Staff review letter dated June 23, 2006.
