<br />.' <br /> <br />Councilmember Pearson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-06-199 <br /> <br />RESOLUTION GRANTING FINAL PLAT APPROVAL TO KELLY ACRES <br /> <br />WHEREAS, John Osborne and Kelly Wolf, hereinafter referred to as "Developer", have <br />properly applied for final plat approval on the following described property located in the City of <br />Ramsey: <br /> <br />Lots 2 and 3, Block 1, LETENDRE ADDITION, according to the recorded plat <br />thereof, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />WHEREAS, on April 21, 2005, the Planning Commission reviewed the sketch plan for <br />Kelly Acres. <br /> <br />WHEREAS, on February 5, 2006, the City of Ramsey received an application for a <br />preliminary plat for subdivision from the Developer; and <br /> <br />WHEREAS, on March 3, 2006, the Planning Commission reviewed the application <br />materials, and recommended approval of the preliminary plat with the following contingencies: <br />MPCA approval of the common septic system, resolution of the lot size issues for the existing <br />homes (specific to Kelly Acres), completion of the traffic study, and City Council re- <br />consideration of the cluster ordinance. <br /> <br />WHEREAS, the City Council met on April 11, 2006 and approved the preliminary plat <br />application contingent upon the following items: 1) compliance with City Staff review letter <br />dated February 28,2006, revised April 5, 2006, 2) obtaining approval from MPCA for the design <br />and location of the community septic system, 3) the City approving the Articles of Incorporation <br />and Declaration of Covenants for the Home Owner's Association at Final Plat, 4) the Developer <br />engaging the services of a professional management firm to manage the community septic <br />system, with a requirement that the management firm be approved by the City, 5) the Developer <br />entering into a Development Agreement as part of the Final Plat approval that will address the <br />payment of Sewer and Water Trunk and Access charges and the responsible party for the <br />maintenance and abandonment of the community septic system; and <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the City of Ramsey hereby grants Final Plat approval for the development of Kelly <br />Acres, contingent upon the following items: <br /> <br />I. Compliance with City Staff review letter dated June 23, 2006. <br />
