Councilmember Buscher introduced the following resolution and moved for its adoption:

RESOLUTION #26-228

RESOLUTION MEMORIALIZING THE CITY’S POLICY REQUIRING COMPLIANCE
WITH MINN. STAT. § 16C.285 RESPONSIBLE CONTRACTOR FOR PROJECTS
RECIEVING CITY FUNDING GREATER THAN $50,000

WHEREAS, On September 22, 2026, at the Ramsey City Council Work Session, the
Council discussed the requirements of Minn. Stat. § 16C.285 regarding Responsible Contractors
and the City’s options for incorporating a requirement for compliance for projects that receive
financial assistance from the City; and

WHEREAS, the City Council recognizes that projects that receive financial assistance
from the City require a greater level of scrutiny and protection due to the use of public funds and
the Responsible Contractor criteria and reporting requirements under Minn. Stat. § 16C.285
provide a reasonable framework for creating that additional scrutiny and protection; and

WHEREAS, at the October 13, 2026 Council meeting, the Council considered the
following policy:

Any project receiving financial assistance from the City valued at more than
$50,000 shall be required to meet the minimum criteria for a responsible contractor
identified in Minn. Stat. § 16C.285, subd. 3, and shall comply with the reporting
requirements provided in Minn. Stat. § 16C.285, subd. 4, 5, and 6, as applicable.

NOW THEREFORE, BE IT RESOLVED BY THE CITY OF RAMSEY, ANOKA
COUNTY, STATE OF MINNESOTA, as follows:

1. Responsible Contractor Policy
(a) Any project receiving financial assistance from the City valued at more than
$50,000 shall be required to meet the minimum criteria for a responsible contractor
identified in Minn. Stat. § 16C.285, subd. 3, and shall comply with the reporting
requirements provided in Minn. Stat. § 16C.285, subd. 4, 5, and 6, as applicable.
(b) Projects receiving $50,000 or less in financial assistance from the City and
privately funded projects shall not be required to comply with Minn. Stat. § 16C.285.
The motion for the adoption of the foregoing resolution was duly seconded by Councilmember
Peters, and upon vote being taken thereon, the following voted in favor thereof:

Mayor Heineman
Councilmember Buscher
Councilmember Peters
Councilmember Riley
Councilmember Specht
Councilmember Stewart
