CC Regular Session <br />Meeting Date: <br />Primary Strategic Plan Initiative: <br />10/27/2026 <br />5. 9. <br />Title: <br />Adopt Resolutions #26-237 and #26-238 Denying a Variance to Lot Depth and Denying the Preliminary Plat for Rum River <br />Retreat (Project No. 26-106); Case of Sundance Woods, LLC <br />Purpose/Background: <br />On October 13, 2026, the City Council took multiple actions concerning a project known as Rum River Retreat, which is <br />located at 17650 and 17400 Erkium Street (together, the "Subject Property"). First, the City Council denied a variance to lot <br />depth for Lots 1 & 2, Block 2 Rum River Retreat as the lots had the ability to meet the lot depth. Subsequently, the City <br />Council denied the Preliminary Plat, because, without a variance to lot depth, the Preliminary Plat did not conform to City <br />Code. Per Minnesota Statutes § 15.99, subd. 2, these decisions need to be documented in writing, which is the purpose of <br />this case.
