Councilmember
its adoption:
introduced the following resolution and moved for
RESOLUTION #26-237
A RESOLUTION MEMORIALIZING CITY COUNCIL'S DENIAL OF THE
VARIANCE REQUEST TO THE REQUIRED LOT DEPTH FOR LOTS 1 AND 2,
BLOCK 2, RUM RIVER RETREAT
WHEREAS, at the October 13, 2026 Ramsey City Council meeting, the City
Council considered a preliminary plat and related variance application for a proposed
residential development known as "Rum River Retreat" (the "Project");
WHEREAS, as part of the Project applications, the Applicant, Sundance Woods,
LLC, requested a lot depth variance for Lots 1 and 2, Block 2, of the Project. The City
Code requires that lots in the Rural Residential Zoning District be at least 200 feet deep.
The Applicant requested that the two lots be granted a variance to be 185 feet deep due to
the existing permanent road easement and tree loss that would occur if the road corridor
was adjusted ("Requested Variance"); and
WHEREAS, a motion was made to approve the Requested Variance and the
Council voted 3-3, meaning the vote failed to receive the required majority vote; and
WHEREAS, pursuant to the requirements of Minn Stat. § 15.99, subd. 2, when a
vote on a properly made motion to approve a request fails for any reason, the failure shall
constitute a denial provided that those voting against the motion state on the record the
reasons why they oppose the request; and
WHEREAS, the three Councilmembers voting against the motion provided the
following reason for their denial: The Applicant has the ability to meet the lot depth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Ramsey, Minnesota, as follows:
1. The Requested Variance is denied because the Applicant has the ability to meet the lot
depth.
Adopted by the City Council of the City of Ramsey, Minnesota, this 27th day of October,
2026.
