The proposed
location of the sign is in the center median on 170th Avenue NW, the main entrance to the
development off of Nowthen Blvd, which falls within the public road right-of-way. The sign
permit has not been issued because currently, City Code does not allow signs to be placed or
constructed within the public road right-of-way. The City Attorney has recommended against
permitting a sign in the right-of-way. Planning Staffhas acknowledged that the sign would be an
aesthetic benefit. The consensus of the Public Works Committee was that the developer should
proceed with applying for a conditional use permit through the Planning Commission to place
the sign in the right-of-way, with conditions included in the permit.

No action required.

2) Consider Modification to the Municipal State Aid System

City Engineer Jankowski stated staff reviewed the existing MSA system with the Committee and
proposed the addition of a new segment, 173rd Avenue (County Highway 63) between
Armstrong Blvd and Variolite Street to the City's MSA system. In order to have sufficient
mileage ayailable to be able to add this segment in it will be necessary to remoye 0.45 miles

City Council/March 13, 2007
Page 16 of21
