C <br />Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #07- 03 -XXX <br />RESOLUTION APPROVING 4 TH PARTIAL PAYMENT TO W.B. MILLER INC. FOR <br />I.P. #05 -23 EBONY STREET IMPROVMENTS <br />WHEREAS, the Ramsey City Council authorized the preparation of plans and <br />specifications for the above referenced work on May 24, 2005; and <br />WHEREAS, the Ramsey City Council approved the plans and specifications and the <br />advertisement for bids for the above referenced work on July 12, 2005; and <br />WHEREAS, bids were opened and tabulated according to law; and <br />WHEREAS, on August 23, 2005, the Ramsey City Council adopted Resolution #05 -08- <br />285 awarding the bid for I.P 05 -23 Ebony Street to W.B. Miller, Inc. in the amount of <br />$247,795.05; and <br />WHEREAS, Change Order Not was approved by City Council on increasing the current <br />contract amount to $255,912.05; and <br />WHEREAS, City Engineer, Steve Jankowski has inspected the completed work and <br />recommends partial payment to W.B. Miller, Inc. the amount of $56,381.02. <br />WHEREAS, City Engineer, Steve Jankowski has inspected the completed work and <br />recommends partial payment to W.B. Miller, Inc. the amount of $13,338.27. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the City Council hereby authorizes partial payment to W.B. Miller Inc. for <br />Improvement Project #05 -23 in the amount of $13,338.27. <br />2) That the City Council hereby accepts the project and authorizes the Mayor or City <br />- - - - -- - - - -- Administrator to sign the release form for this payment. <br />3) That the total amount of this payment is not included in resolutions approving payment of <br />bills for the date of March 27, 2007. <br />4) That the City of Ramsey Finance Department will be provided a signed copy of this <br />resolution. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />, and upon vote being taken thereon, the following voted in favor thereof: <br />RESOLUTION #07- 03 -XXX <br />Page 1 of 2 <br />-65- <br />
