CASE # 1 <br />ADOPT ORDINANCE TO VACATE EASEMENTS IN GEBERT'S ADDITION; <br />CASE OF OAKWOOD LAND DEVELOPMENT <br />By: Amy Geisler, AICP, Associate Planner <br />Background: <br />Oakwood Land Development received approval on February 27, 2007 to proceed with a metes <br />and bounds subdivision related to the extension of 167 Avenue NW. As part of that process, an <br />easement vacation is needed for portions of two lots in Gebert's Addition. <br />The following items are enclosed for your information: <br />a) Site location map <br />b) Exhibit and description of underlying easements'to be vacated <br />C) Proposed ordinance to vacate easements <br />Notification: <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public hearing to vacate easements. <br />Funding Source: <br />All staff costs associated with the review of land use applications are paid for by the applicant. <br />Observations: <br />The ordinance was introduced on February 27, 2007 and is now eligible for adoption. <br />Recommendation: <br />City Staff recommends adoption of the ordinance to vacate the drainage and utility easements as <br />shown in the exhibit of Gebert's Addition. Staff is recommending that the approval be contingent <br />upon the applicant recording the metes and bounds subdivision related to the extension of 167 <br />Avenue NW. <br />—77— <br />
