<br />Mr. Jim Overtoom, 16660 Jasper Street NW, stated for several years they have discussed the <br />southern route of 167th Street. He commends Mr. Peterson and Oakwood Development <br />Company for pursuing this development of the street to the south of the plat he is working on. <br />He encourages its use and furtherance. He would like to point out another project within the <br />State of Minnesota dealing with public access and public ownership of land. That project is <br />dealing with a baseball field and owners of land, and a government entity that does not have <br />control of that land, and the stalemate that has occurred. His question is what precedent is set if <br />the re-platting of this development is allowed, and the road does not go through. The following <br />question is whether the City has control of the remainder of the road right-of-way, and whether it <br />is possible to acquire that before this platting is completed, or if the City will end up in the type <br />of situation Hennepin County has gotten into. <br /> <br />Public Works Director Olson stated the City does not control that piece of land to the south as is <br />indicated on page 86 in the meeting packet. The City will not' end up with a Hennepin County <br />situation. When the road project moves forward the agreement made with Oakwood Land <br />Development was that they were to try to secure as many of the properties for the alignment as <br />they could through negotiations. Oakwood has indicated there is at least two, if not three, <br />properties they could not reach agreement with. At some point in the future when and if this <br />project moves forward with the extension of 167th Avenue and the creation of the new roadway <br />there will need to be negotiations between the City and the property owner. <br /> <br />Mr. Tony Lee, 16685 Garnet Street NW, inquired about the moratorium on development. <br /> <br />Associate Planner Geisler explained there was a development moratorium put in place for the <br />Rural Developing District, which includes these properties. The moratorium was put in place for <br />the City Council to look at the zoning standards for that district. The Council recently adopted <br />new standards for this area that requires 2.5 acre lot standards. Those standards have not had <br />time to take effect, so the moratorium is still on. An exception is required to move forward with <br />development in the moratorium area. <br /> <br />Mr. Lee asked what the zoning status will be in this area after May 15th. <br /> <br />Associate Planner Geisler replied new lots will be required to have a minimum of 2.5 acres. <br /> <br />Mr. Lee stated when he bought into Ramsey ten years ago he expected big lots, then <br />development came in and they got small lots. He stated he only uses about half of his three acres <br />and asked whether he would be able to develop his property after May 15th. <br /> <br />Associate Planner Geisler replied Mr. Lee could follow the same process Oakwood Development <br />followed, which was to apply for a Comprehensive Plan amendment to receive city sewer and <br />water and develop at urban densities. <br /> <br />Motion by Councilmember Olson, seconded by Councilmember Elvig, to close the public <br />hearing. <br /> <br />City Council / February 27, 2007 <br />Page 9 of21 <br />
