<br />Councilmember Jeffrey introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-02-063 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0791 RELATING TO A <br />REQUEST FOR A VARIANCE TO THE PLATTING REQUIREMENTS IN CITY CODE <br />TO ALLOW A METES AND BOUNDS SUBDIVISION <br /> <br />WHEREAS, Oakwood Land Development, Inc., hereinafter referred to as "Applicant", <br />has properly applied for a variance to platting requirements established in Section 9.50 <br />(Subdivision) of the Ramsey City Code to facilitate a metes and bounds subdivision to facilitate <br />right-of-way acquisition for the extension of 167th Avenue in association with the plat of <br />Brookfield Addition. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the City Council acting as the Board of Appeals for a <br />public hearing on February 27, 2007, and that said public hearing was properly advertised <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br /> <br />2. That the Applicant is the developer of Brookfield Addition, which received preliminary plat <br />approval from the City on September 13, 2005. <br /> <br />3. That as part of this approval, the City Council directed the Applicant and Staff to pursue a <br />new alignment of 16th Avenue NW south of the plat of Brookfield. <br /> <br />4. That the Applicant has assembled four parcels south of the plat of Brookfield for the <br />purposes of providing land for the 16ih A venue right-of-way to the City. <br /> <br />5. That in order to provide this right-of-way to the City, a subdivision is necessary to split these <br />existing parcels to deed the land to the City. <br /> <br />6. That in addition to deeding this land to the City, the Applicant wishes to sell the existing <br />homes and retain several remnant parcels for future development. <br /> <br />7. That these remnant parcels will not be considered buildable until such time that City sewer <br />and water are available, and these remnant parcels are platted in accordance with Section 9.50 <br />of City Code. <br /> <br />8. That Section 9.50 (Subdivision) of City Code requires that any new lots be created through <br />the platting process. <br />
