<br />Commissioner Cleveland noted this plat now consists of two-level townhomes, and is different <br />from the previous plat that included single level townhoines. She asked if there will be variances . <br />coming forward for this plat. <br /> <br />Associate Planner Dames replied there will not be any variances required for this plat. <br /> <br />Commissioner Van Scoy clarified with Associate Planner Dalnes that 60 feet of right-of-way <br />would be required, rather than 45 feet if the adjacent parcels were to put the adjacent street at the <br />rear of the property instead ofelose to CR 5. Running the street to the rear is a possibility, but it <br />includes these properties losing an additional IS feet of right -of-way. <br /> <br />Associate Planner Dahies stated there is also the issue of aesthetics. With the street in 'the rear, <br />the backs of the units would face the roads !ll1d the fronts would face the backs of the single- <br />family homes across the new street. . <br /> <br />Commissioner Brauer asked if the temporary cu1-de-sa~ will eventually link. up with 14Sth. <br /> <br />Associate Planner DaInes explained part of the reason for requiring the temporary cul-de-sac is to <br />be able to take the accesses off of CR 5 and still provide public access to aU three properties with <br />less right-of-way than would normally be required. Mr. Wellman is correct that the new road <br />will have to bisect the property just south of 146"', but there is still development potential on that <br />property at the same density that Pine Prairie has proposed. <br /> <br />Commissioner Brauer questioned if the diagonal cutting across the lots could become a situation . <br />of taking, <br /> <br />Associate Planner DaInes replied all developments are requIred to provide a public road. <br /> <br />Mr. Deemer stated regarding the access, there were several misstatements made tonight. There <br />are' not three accesses onto CR 5; there are four, including this lot and three others. The young <br />lady stated that developments require roads. However, Chapter 9 only requires frontage on a <br />public road; not new roads. If this will be a city street, a 45 foot wi<;i1h requires a variance; code <br />requires the width to be 60 feet. Mr. Deemer stated when he attempted to develop over two years <br />ago be obtained a letter from the County for access on the property, and gave a trade off to have <br />that access. Those letters are in the hands of the new buyer. That access lfues up immediately <br />across from the Lord of Life Church access, and that would be the ideal, access for any new <br />access instead of offset T's. Those are some of the facts as he sees them. <br /> <br />Motion by Commissioner Van. Scoy, seconded by Commissioner Cleveland, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Acting Chairperson Levine, Commissioners Van Seey, Cleveland, <br />Brauer, Hunt, and Trites Rolle. Voting No: None.
