It operated as a valid non- <br />conforming use, manufactUring microwave components and subsystemS at <br />a facility on the property. In April 2004, it applied to the tOWIl'S zoning <br />commission for permission to relocate its parking lot, which entailed con- <br />structing a new 20-space parking lot behind its'facility. <br />A public hearing was held, and Thomas, a neighboring property' OWIleJ; op- <br />posed the application. He claimed that the proposed construction required a spe. <br />cia! permit, and LE's application did not meet all of the permit criteria. Thomas <br />argued that creating the lot amounted to an illegal expansion of a nonconform. <br />ing use. Despite these objections, the commission approved the application. <br />Thomas appealed. The court found in favor of the commission, stating that <br />a regulation related to off-street parking ~ and riot the restrictions on non- <br />conforming uses - controlled the case.
