Case #3: <br /> <br />Adopt Ordinance to Vacate Easements in Ramsey Commercial Park; Case of <br />Charles Christian <br /> <br />Zoning Administrator Frolik reminded Council that Mr. Charles Christian is in the process of <br />replatting Ramsey Commercial Park, which requires vacating existing utility and drainage <br />easements to make way for new easements to be dedicated along the newly drawn property lines. <br />Council introduced the ordinance on December 9, vacating those pre-existing utility easements. <br />Ms. Frolik stated this is a standard action - this is not intended to correct drainage in that area. <br />She noted that the ordinance is now ready for formal adoption. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Ordinance #98-01 to vacate all drainage and utility easements within the boundaries of Ramsey <br />Commercial Park. <br /> <br />A roll call vote was performed by the Deputy City Clerk. <br /> <br />Councilmember Beahen aye <br />Councilmember Zimmerman aye <br />Councilmember Haas Steffen aye <br />Councilmember Beyer aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case#4: Request for Final Plat Approval of Rademacher Addition; Case of <br /> Rademaeher Companies, Inc. <br /> <br />Zoning Administrator Frolik stated that Rademacher Companies, Inc. is requesting final plat <br />approval to split their parcel in the southeast quadrant of the intersection of T.H. #47 and 153rd <br />Avenue. They plan to develop a convenience store on Lot 1 and hold Outlot A for future <br />development. The subject property is zoned a combination of B-2 Business and R-3 Urban <br />Residential. There is a small remnant of property in the northwest comer of Outlot A that is still <br />zoned B-1 Business. The Council introduced an ordinance to rezone this remnant to R-3 Urban <br />Residential, however that rezoning ordinance cannot be finally adopted until the development <br />moratorium is lifted. The Park Commission is recommending a cash payment to satisfy park <br />dedication. The developer will also be required to continue the pedestrian path along the east <br />side of T.H./447 along the west boundary of Lot 1. Ms. Frolik continued that with the exception <br />of a temporary right-in only at the common boundary of Lot 1 and Outlot A, right-of-access <br />along T.H. #47 is proposed to be dedicated to the State. The development agreement will require <br />the developer to transfer the access rights for the temporary fight-in to the State at the time 153rd <br />is signalized. <br /> <br />City Engineer Jankowski stated that the outlot has to be re-subdivided before a building permit is <br />issued. Staff told the developer we are intending an extension of Barium Street to 153rd Avenue. <br />The temporary right-in will go away when 153rd Avenue is signalized. <br /> <br />City Council/January 13, 1998 <br /> Page 7 of 14 <br /> <br /> <br />
