She further stated that <br />much of this water was coming off of the new subdivision to the north (The Meadows) which <br />should be taking care of its own drainage. <br /> <br />A review of The Meadows drainage plan provides for a large retention pond located just <br />northwest of Mrs. Asmussen's property. Roughly on half of the drainage from this subdivision <br />is designed to be drained into this pond through catch basins placed along Helium Street. <br />The southernmost of this series of catch basins is located 160 feet north of the plat boundary <br />with Pondvale Estates. Therefore only the southernmost 160 feet of roadway from the <br />Meadows subdivision should flow into the pond located on Mrs. Asmussen's property. <br /> <br />On March 21, 2007 \ visited the site and found all the catch basins on Helium Street to be <br />open and clear of debris. The final lift of bituminous has not been placed on Helium Street, so <br />that the front of the curb flange is about one inch higher than the edge of the bituminous. <br />Almost all of the snow and ice had meited from the large storms experienced two weeks ago, <br />except for the last 100 feet of Helium Street from the Asmussen pond. I noticed a layer of ice <br />covering the concrete curb and extending six inches to a foot onto the bituminous pavement. <br /> <br />It is my opinion that what Mrs. Asmussen observed was indeed all of the drainage from the <br />area destined to flow into The Meadows detention pond was flowing into the pond on her <br />property. The reason for this was that the catch baslns were not functioning because the <br />water was not the flowing along the concrete gutter but rather was flowing along the edge of <br />the bituminous pavement or the edge of the snow bank. ] believe that this street was not <br />plowed to its fuIJ width so as to prevent chipping the edge of the exposed curb, and as a <br />result the several feet of snow bank compressed into a sheet of ice which froze the curb line <br />shut. Some evidence still remained at the time of my site visit. <br /> <br />This situation should not reoccur in the future because of the fact that the final lift of <br />bituminous will be placed prior to next winter and that Helium Street will be plowed to its full <br />width making the catch basin functional. I have called Mrs. Asmussen and discussed these <br />fmdings with her. <br /> <br />a5WI In/tV <br />
