Case #7: <br /> <br />Adopt Ordinance to Rezone Property from B-1 Business to R-3 Urban <br />Residential; Case of Rademaeher Companies, Inc. <br /> <br />Action on this case would require a four-fifths vote. Due to only three Councilmembers <br />present, this case was tabled. <br /> <br />Case#8: Award Contracts for Divisions C and D of the 1998 Street <br /> Maintenance Program <br /> <br />City Engineer Jankowski reported that the 1998 Street Maintenance Program consists of <br />seven crack fill and sealcoat projects covering 12.5 miles of City streets and five overlay <br />projects covering 3.7 miles of residential streets and 4.0 miles of MSA streets. On July <br />14, Council awarded Division A and B which covers the crack sealing and sealcoating <br />work. Divisions C and D, which cover bituminous overlays and a street construction <br />project in Bums Township adjacent to an overlaying project, were not awarded at that <br />time. Division C needed to receive approval from MnDOT since a large portion of the <br />contract involved MSA streets, and consequently, State funding. Division D required an <br />agreement with the Bums Township to ensure that Ramsey would be reimbursed for the <br />project costs associated with Division D. He had indicated in the Council agenda that the <br />draft agreement between Ramsey and Bums would be available for Council review, <br />however, due to a family emergency, City Attorney Goodrich was unable to complete the <br />draft in time. Staff is asking for Council approval of Division D, contingent upon the <br />Attorney drafting such agreement. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution #98-08-171 awarding Division C of the 1998 Street Maintenance Program to <br />W.B. Miller, Inc. in the amount of $326,593.03. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman and Beyer. <br />Voting No: None. Absent: Councilmembers Beahen and Haas Steffen. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution #98-08-172 awarding Division D of the 1998 Street Maintenance Program to <br />W.B. Miller, Inc. in the amount of $22,550.00, contingent upon the City Attorney <br />drafting an agreement and upon Bums Township entering into the agreement to <br />reimburse the City of Ramsey for all costs associated with Division D. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman and Beyer. <br />Voting No: None. Absent: Councilmembers Beahen and Haas Steffen. <br /> <br />Case #9: <br /> <br />Review Proposed Ordinance Identifying Those Areas of the City <br />Which are not Required to Connect to City Sewer and Water <br /> <br />City Attorney Goodrich stated that Council directed him to advise them of the provisions <br />in Ramsey which would protect residents from having to be serviced by City sewer and <br /> <br />City Council/August 11, 1998 <br /> Page 9 of 15 <br /> <br /> <br />
