Stat. ~609.74 <br />defines a nuisance as: <br /> <br />Whoever by an act or failure to perform a~ legal duty <br />Intentionally does any of the following is guilty of <br />maintaining a public nuisance, which is a misdemeanor: <br /> <br />(1) Maintains or permits a condition which unreasonably <br />annoys, injures or endangers the safety, health, morals, <br />comfort, or repose of any considerable number of members of <br />the public... <br /> <br />This statute is criminal law. <br /> <br />Minn. Stat. ~116.07 explaines that Gunc]ubs are exempt from <br />standards by the state, but are not exempt from rules <br />adopted by local government. <br /> <br />Mtnn. Stat. ~116.07 reads as follows: <br />Subd. 2a EXEMPTIONS FROM STANDARDS. No standards adopted by <br />any state agency for limiting levels of noise in terms of <br />sound pressure which may occur in the outdoor atmosphere <br />shall apply to...(2) skeet, trap or shooting sports <br />c]ubs...NothinG herein shall prohibit a local unit of <br />government or a public corporation with the power to make <br />rules for the Government of its rea] property from <br />regulating the location and operation of skeet, trap or <br />shooting clubs... <br /> <br />With consideration of the nuisance issue, we feel that our <br />local Government needs to address this problem without <br />delay. <br /> <br />Thank You. <br /> <br /> <br />
