These two lots, along with Lot 3, are owned by
Jennifer and Todd Asmussen who appeared at the September 8, 1998, Council meeting during
Citizen Input and indicated the filling of the lots was an attempt to stabilize a chronic erosion
problem in the depression that was constructed within the easement. Mr. Jankowski explained
that the purpose of the easement is to contain storm water coming off Helium Street and to
prevent discharge of this water onto the adjoining property over which the City has no easement.
The Road and Bridge Committee suggested that a policy be formulated to address the
responsibilities associated with such easements, and also directed that the City rectify this
particular situation to the satisfaction of the property owner. To accomplish this, Staff is
recommending that the fill be removed and the depression regraded to its pre-filled contours, that
four inches of top soil be spread over the side slopes, and that sod be placed on the side slopes to
control erosion and provide an aesthetic appearance. The cost of this work is estimated to be
$3,500 and could be financed from the Public Improvement Revolving (PIR) Fund. Mr.
Jankowski stated it is the recommendation of the Road and Bridge Committee to restore and
stabilize the drainage and utility easement on Lots 1 and 2, Block 2, Pondvale Estates.

Councilmember Haas Steffen inquired about the timing of this project.

Mr. Jankowski stated it will probably be a spring project.

Councilmember Haas Steffen asked if the Asmussen's are satisfied with this proposal.

Todd Asmussen stated he received a letter but did not understand what was being proposed.
